City Of Boulder Legal requirements:

The City of Boulder has a legal requirement regarding multiple pieces of information that must be included in all leases. This requirement does not exist anywhere else in the U.S. BARHA members have access to legal materials developed specifically to fulfill this city requirement. These materials are available free of charge to BARHA members.

Specific quality of life ordinances exist in the City of Boulder that need to be understood by all property owners/managers. These laws actually go so far as to hold landlords' liable for the actions of tenants. It behooves all who are in the rental business to be familiar with these laws. BARHA provides written materials and education about these issues and also has available FREE of charge an excellent Rental Lease that protects owners.


 
Federal Legal Requirements:

The U.S. Govt. also requires Lead Paint notifications be made prior to signing a lease on properties built prior to 1978. This information and copies of the required federal booklets and forms are also available free to BARHA members.

In 2007 the Environmental Protection Agency conducted a surprise audit on realtors and residential rental owners to insure that these federal requirements were being met. BARHA members were alerted via our email system that these audits were occurring, allowing our members to be prepared. It was great to have the auditor tell our director that the BARHA members he audited had the best understanding and had kept the best records of any group he had audited- not a single member of BARHA was fined.

Unfortunately, many non-BARHA members had not followed the law and suffered significant fines as a result.
